Terms of Service
Effective date: February 10, 2026. These Terms govern your access to and use of Get Your TREK Guide, including booking, payment, reviews, and account use.
1. Acceptance of Terms
By creating an account, browsing guides, or making a booking, you agree to these Terms and our applicable policies. If you do not agree, do not use the platform.
2. Platform Role
Get Your TREK Guide is a marketplace connecting clients with independent guides. Guides provide services directly. We provide discovery tools, booking workflows, and payment facilitation.
3. Eligibility and Accounts
You must provide accurate information, keep credentials secure, and use the platform lawfully. You are responsible for activity on your account and must notify us of unauthorized access.
4. Guide Verification and Listings
Guides may be required to complete KYC and provide identity and certification documents. We may approve, reject, suspend, or remove listings that are inaccurate, unsafe, unlawful, or non-compliant with platform policies.
5. Booking, Pricing, and Commission
Guide prices are set by guides unless otherwise stated. Platform commission is 15% on eligible booking transactions. Commission treatment and payout breakdown are shown in applicable dashboard records.
By completing checkout, you authorize payment processing through our payment provider and agree to the displayed transaction totals.
6. Cancellations, Refunds, and Chargebacks
Cancellation and refund outcomes depend on the service terms, timing, and applicable policy shown at booking. Fraudulent disputes or abusive chargeback behavior may result in account restrictions.
7. Reviews, Testimonials, and Integrity
Reviews must reflect genuine experience. Fake, purchased, AI-generated, manipulated, or misleading reviews are prohibited. Undisclosed insider endorsements and review suppression tactics are not allowed. We may moderate or remove content and restrict accounts for violations.
8. Prohibited Conduct
You may not use the platform for unlawful conduct, harassment, discrimination, fraud, unsafe guiding practices, inaccurate identity claims, payment abuse, or misuse of another person’s data or intellectual property.
9. Safety and Compliance
Users must comply with local regulations, permits, and safety requirements. Travelers are responsible for personal readiness and insurance. Guides are responsible for lawful operation within their service scope.
10. Intellectual Property
Platform design, branding, and software are owned by Get Your TREK Guide or licensors. You retain rights to your own content but grant us a non-exclusive license to host, display, and process it for platform operation.
11. Disclaimers
Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted operation, specific trek outcomes, weather conditions, or third-party performance.
12. Limitation of Liability
To the maximum extent permitted by law, Get Your TREK Guide is not liable for indirect, incidental, special, or consequential damages. Total liability for direct claims is limited to amounts paid to us for the relevant transaction in the preceding 12 months.
13. Indemnification
You agree to indemnify and hold harmless Get Your TREK Guide from claims, losses, and costs arising from your misuse of the platform, policy violations, or unlawful conduct.
14. Suspension and Termination
We may suspend or terminate access for policy violations, risk concerns, legal obligations, or fraudulent activity. Certain obligations survive termination, including payment and dispute terms.
15. Changes to These Terms
We may update these Terms from time to time. Updated terms are effective when posted with a revised effective date. Continued use after changes means acceptance of revised terms.
16. Governing Law
These Terms are governed by applicable law of our operating jurisdiction, unless mandatory law requires otherwise. You agree to attempt good-faith resolution before formal proceedings.
